I bought my house 3 years ago , only to find my chimney is resting on rafters !?

i bought a house 3 years ago , only to find one chimney has been removed from the back room , this is not a problem , when i have inspected the loft , the top half of the is still there ??? is it just resting on my ceiling ?? would my building surveyor who checked the proerty before i bought it , be liable for not noticing ?? would my building insurance cover this ??
